Murder
Murder is considered one of the most serious crimes and defines itself in Article 394 of the Penal Code as follows;
"Premeditated manslaughter is called murder. He is punished with life imprisonment"
What exactly does this premeditation mean? The word actually says it all, one has thought about the crime before committing the act. One acted consciously and planned, and one had the intention to kill. One did not act on a whim or under intense emotion. Thus, one must be in a sufficiently stable state of mind before one can speak of premeditation. The factual context and elements in the criminal record will either prove this premeditation or not. Thus, it is very important to consult a specialized lawyer so that all aspects are correctly represented during the trial.
It is up to the prosecution to prove whether premeditation actually occurred. For example, a classic example of this is a case where one finds an entire plan on the defendant's laptop, which was then put into practice. One figured out in advance where and how one would purchase a weapon, and one did searches, for example, about exactly where to hit someone so that they would certainly not survive the attack.
If the Court and the jury are of the opinion that the offender took someone's life in a deliberate and planned manner, it is punished particularly severely. However, extenuating circumstances may be assumed, allowing for a lesser sentence.
